In today´s economic environment increases the need to integrate into Russian legislation some features of regulating relations on trust management, available in foreign legal systems. From this position the author estimates the need for changes in the legislative regulation of trust agreements in the Russian legislation. The author proposes corrections to Chapter 53 of the Civil Code of the Russian Federation, which should reduce the number of claims related to the trust agreements.

Институт договора доверительного управления используется в качестве правового механизма осуществления правомочий владения и пользования имуществом в интересах его собственника третьим лицом, как правило профессиональным управляющим, во всех правопорядках и странах. В настоящее время отмечается глобализация экономических процессов, тенденция к унификации правовых норм в законодательстве различных стран, прежде всего европейских. В этих условиях требуется учет многообразия подходов к управлению имуществом в развитых правопорядках при разработке национальных правил о доверительном управлении, прежде всего в правоприменительной деятельности, ориентированной на взаимодействие с иностранными хозяйствующими субъектами.
В статье на основе сравнительно-правового метода проводится анализ законодательства ряда европейских стран с целью выявить современные трактовки ответственности и прав доверительного управляющего, механизмы налогообложения и вознаграждения в отношениях доверительного управления и меры по сокращению мошеннических действий для повышения эффективности функционирования института доверительного управления в российском законодательстве.
